In connection with the current situation, we have observed rapid growth in debt collection cases in our office. Our clients are starting to record more overdue claims than usual.
If a similar problem also affects you or your company, it is important to find out the financial situation of your debtors and decide how to dispose of your claim further. For example: to sell, to acknowledge the debt, or to negotiate a repayment schedule with the debtor or file a lawsuit in court. If the claim goes into execution, a first-come-first-served principle applies, and claims are satisfied in order. It is therefore important to file a lawsuit in court as soon as possible.
If the debtor refuses to pay you the amount due or it is not possible to contact him/her, you can file a lawsuit. Before filing a lawsuit in court, it is advisable to send the debtor a pre-action call for payment, which entitles you, if successful in court, to demand the debtor to also reimburse you for the costs of legal representation associated with the court proceedings. According to our experience, a pre-action call for payment, especially if it is written by a lawyer, has in most cases a psychological effect on the debtor, when he realizes that the creditor is ready to enforce the claim in court. In many cases, the debtor will pay the amount due already on the basis of such a pre-action call for payment. Alternatively, the dispute can be settled out of court.
